The Colorado Legislature passed a bill regarding maintenance awards in Colorado divorce actions on July 1, 2001. The law was created to provide family law litigants, attorneys, and judges with a way of determining the amount of maintenance to be paid during a divorce. The courts are directed to consider 40% of the higher earning spouse's monthly adjusted gross income, minus 50% of the lower earning spouse's monthly adjusted gross income. The formula will only apply to those cases where the combined income of the divorcing parties is $75,000 or less per year, and even then only for "Temporary Orders", or for orders entered during the divorce.
