Guardianships always require the permission of the parent, so an informal guardianship will work as long as the minor child's mother agrees that the child should live with you. There is a form JDF 751 that allows the mother to delegate to you most of the decision making for the child. Schools in the Metro area generally allow a child to be enrolled based on this form. Whether she can be on your health insurance will depend on your health insurance provider.
This type of guardianship is relatively easy, inexpensive and effective. If the mother asks that the child to be returned to her, Colorado will have jurisdiction over the child after she has lived in Colorado for 6 months. Other types of “custody” could be discussed at this 6 month point.
