As a result, Colorado courts do not have jurisdiction to dissolve same-sex marriages performed in other states. In order to obtain a legal divorce, you will have to petition in a state which either recognizes same-sex marriage or has agreed to dissolve same-sex marriages (i.e. Wyoming). Two Common Legal Mistakes of Same-Sex Couples When Combining Households

Two Common Legal Mistakes of Same-Sex Couples When Combining Households When any couple enters a long term relationship, each party brings with them their own financial estates. For couples who can legally marry, there is a statutory definition of which property is “separate” from the marriage and which property is “marital property.” The same is true for couples who never legally marry but instead have a common law marriage. However, for same-sex couples, there is a distinctive lack of statutory or other guidelines which detail how the financial estate of each …

What is an Equitable Distribution of Marital Property?   Because Colorado is an “Equitable Distribution” state, the division of marital property and debt is settled during divorce proceedings.  The courts seek to have all marital property, or that which was acquired during the course of the marriage, divided between the parties in an equitable manner unless an alternative agreement is made.  If the spouses cannot agree, then the Court will intervene and assist the parties in the division of marital assets and debt.   For more information about the d …

Does the Non-Bio Mom Have Rights in a Same-Sex Relationship?

In order for the non-biological parent to have any standing to seek parental rights, the first thing that needs to happen is that Father's rights need to be terminated. It is simply not enough to have a contract or side agreement with the Father. Instead, he will need to actually file a Petition with the court and the court will need to terminate his rights.   Once Father's rights are terminated, non-biological mother has the option to complete a Second Parent Adoption of the child. Colorado Divorce: Think Twice Before Attempting to Spy on Your Soon to be Ex

Electronic spying in Family Law Cases      The advent of cheap and easily available devices to spy on your ex, or soon ex-to-be, makes it easy to do so. But tread cautiously. Legal, as well as equitable, pitfalls abound. First, under Colorado law, it is a crime to record a conversation unless one party to the conversation consents to the recording. (Some other states require both parties to consent.) If you’re not a party to the conversation, recording that conversation is eavesdropping, a crime under Colorado law. The use of hi …

More than 2 million couples in the US will marry in 2011, but recent U.S. Census Bureau stats show that fewer than half of the households in the United States are currently comprised of married couples. NEW YORK (Reuters Health) – Parents of twins may be slightly more likely to get divorced than parents without twins, according to a new study. The findings "are not surprising, given the stresses that caring for (twins) brings," Dr. John Moore, a pediatrician at Virginia Tech-Carilion School of Medicine in Roanoke who was not involved in the study, told Reuters Health. The difference in divorce rates was small - only 1 percent - and the authors say they can't be sure what would account for the added risk. It's possible, they note, that either the emotional or financial stre …

Eva Longoria and Tony Parker have filed for divorce, but Tony filed in Texas after Eva filed in California. Issues regarding jurisdiction in divorce are more complex than in civil cases. The jurisdictional requirements for an order or judgment for support or attorneys' fees are entirely different from those to obtain custody. Similarly, a court may have jurisdiction to dissolve a marriage, but not be able to issue binding judgments regarding support or custody. For example, a California court could issue a child support order against a father living in California, based on the fathers contact …

New York Last State to Adopt the No-Fault Divorce

Governor David Paterson signed no-fault divorce into law Sunday.  Previously New York judges could only grant a divorce quickly on ground cruelty, adultery, abandonment or imprisonment, meaning a spouse had to prove their mate's wrongdoing.  These options were expensive and time-consuming. Another, more time consuming alternative, was to legally separate for a year and then get a divorce later by consent.  Divorce will now move more quickly for those in this state. This new measure requires one spouse to swear under oath that a relationship has broken down fo …

Congress passed DOMA in 1996, defining marriage as a heterosexual union for purposes of a host of federal benefits and classifications. For many baby boomers with seemingly stable long-term marriages, the notion of separating or divorcing after surviving so many years together remains almost unthinkable. Yet those couples who do separate or divorce in the latter stages of life are doing so because the factors that once kept them together -- raising children, accumulating assets, planning for the future -- have become less important than the question of how they want to spend their time or whether they want to spend it with the same partner, says Dr. Terri Orbuch, also known as "The Love Doctor(R)."
