Child support is generally paid via:
1. Payments made directly by the payor to the recipient
2. Payments via an income assignment from the payor's place of employment to the recipient
2. Payments via an income assignment from the payor's place of employment to the recipient
3. Payments from the payor to the Family Support Registry for the benefit of the recipient
Colorado has various methods that a family law attorney can pursue regarding the collection of back child support:
1. Issuing an income assignment
2. Filing a verified entry of support judgment and affidavit of arrears. When judgement is entered, a support garnishment can be filed the against the payor's income.The judgment can also be used to lien property or seize funds.
3. Collection of child support arrears can also be sought through filing for contempt. The delinquent payor can be subject to fines and/or jail time, and, potentially attorney fees.
4. If the obligor lives out of state, child support aspects of a Colorado case transferred to the state in which the obligor lives for purposes of enforcement.
5. The Child Support Enforcement Unit (CSEU) can intervene to take professional and driver's licenses, seize income tax refunds. The CSEU has the means to track down delinquent payors through the records of the US Department of Labor.
