What is a "No Fault" Divorce?

A "No fault" divorce means that the Colorado divorce courts do not inquire into the reasons for the dissolution of marriage. The reasons for your divorce or legal separation may include issues like infidelity, lack of communication, and/or problems regarding money. Although the reasons for the termination of your marriage are important to you, and addressing them will be equally important as you move through the divorce process with your divorce attorney, the Colorado courts are focused on having you divide your martial assets and debt in an equitable manner and creating a parenting schedule that is in the best interests of the children involved. Removing the element of fault from divorce proceedings allows the Colorado courts to focus exclusively on the legal issues so that you and your children can move forward in a positive direction with the rest of your lives. Working with a qualified family counselor before, during, and after the divorce can be extremely helpful to you and your children as you work through the healing process.
